Preambolo

“Se fossi Parlamentare” e' un esperimento di democrazia partecipativa telematica.

Ogni tipo di democrazia, anche quella partecipativa ha le sue regole, di seguito quelle di "If I were Parliamentary. These rules are given, in accordance with the purposes' "If I were the Parliamentary", the evocative name of "Interim Constitution".

Tale norma e' in parte immediatamente precettiva, in parte programmatica. ²

Funzionamento di “Se fossi Parlamentare”

8. “Se fossi Parlamentare” nasce come gruppo apposito nell'aggregatore di notizie OKNOtizie, in tale gruppo possono essere postate:

a) le proposte di legge originali degli utenti;

b) le leggi discusse alla camera e al senato.

9. E' un gruppo visibile a tutti, ma possono “parteciparvi attivamente” solo gli utenti registrati. ³

10. Per “partecipazione attiva” si intende la possibilita' di postare “proposte di legge”, di discuterle e di votarle.

11. Le proposte di legge possono essere postate, discusse e votate 7 giorni su 7 e 24 ore su 24.

12. La discussione non ha limiti di durata massimi, ma dura minimo fino alle 23:59 dell'8° giorno successivo alla proposta

13. La votazione: dura fino alle 23:59 dell'8° giorno successivo all'inizio della votazione. ⁴

Finanziaria

20. Per la "finanziaria", la discussione inizia l'1 ottobre e si conclude, al massimo il 15 di dicembre. ⁶ Se pero' le divergenze sono insanabili e/o la votazione non arriva al quorum richiesto del 50,1% si passa all' “esercizio provvisorio” o “regime dei dodicesimi”, per cui ogni mese non si può spendere piu' di un dodicesimo dell'esercizio dell'anno precedente o, se le spese sono minori, non piu' di un dodicesimo di quanto previsto nel progetto di legge finanziaria. ⁷

Regole transitorie e finali

Alcune di queste regole hanno carattere “privatistico”, potrebbero essere tolte dal corpus normativo in una 2° fase.

I. La costituzione provvisoria e' flessibile (cioe' modificabile con lo stesso quorum di qualsiasi legge), se approvata democraticamente potra' divenire “rigida”, cioe' modificabile con un quorum piu' elevato.

II. Le "leggi" di "Se fossi Parlamentare" sono, secondo il diritto vigente, di 2 tipi:

A) “Leggi” che possono essere attuate direttamente dagli utenti di OKNOtizie, perche' rientranti nella sfera di autonomia dei singoli e the right of assembly and association under the Italian Constitution (art. 17 and 18);

B) "Law" that can not be implemented by users of OKNOtizie, but that can be replicated using official institutions, as well as to 'Art. 1 and the democratic character of the Italian Constitution, art. 71 of the Italian Constitution, which in paragraph 2 states: "The people may initiate legislation by proposing by at least 50,000 voters, of a draft drawn up in articles."

III. "If I were the Parliamentary" is the brainchild of user OKNOtizie Mikel with the participation of OKNOtizie pcdazero taking inspiration from the post of rickgav: the 3 users have a working relationship with OKNOtizie.
